These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico and the United States, without regard to conflict of law principles.
Any disputes arising from these Terms or the Services shall be resolved in the state or federal courts located in Bernalillo County, New Mexico. You consent to the personal jurisdiction of these courts.
For claims under $10,000, you agree to resolve disputes through binding arbitration in accordance with the American Arbitration Association rules, rather than in court, except where prohibited by law.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pista Works LLC regarding the Services and supersede all prior agreements and understandings.
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
